Benjamin Gains, 28, who operates under the trade name BG Optical, made annual contracts with his staff according to which their salary was as good as the National Minimum Wage (NMW). They were also to be provided with fully paid meal packages during office hours.
However, in reality the employees were given salaries less than the NMW.
After HM Revenue & Customs (HMRC) received complaints about Gains’ unfair policies they contacted him for an investigation. Now desperate to save himself, Gains asked the staff for their contract papers, made changes and even left out the free-meal provision.
The case went up for hearing at the Manchester magistrates court.
Mike Rainford, defence, said Gains had succumbed to “severe financial pressure” following the bank’s threat that they would cut his loan amount or even completely roll it back.
He also told the court that Gains had just been deducting a trifling amount of money from the salary that his employees were supposed to receive under the NMW.
Gains, however, pleaded guilty to violating the NMW Act and cheating four employees. Consequently the court asked him to pay £3,696 as fines.
Previously, Gains had made an offer to pay back his staff if HMRC dropped the case against him. But now Gains is under legal obligation to pay back his staff within 28 days.

The HSE will soon begin an initiative to survey construction sites in an attempt to increase safety and security of construction workers across the UK. This initiative aims at reducing dangerous practices on construction sites.
During 2008 and 2009, 53 construction workers died in the UK and over 11 thousand were injured. Since construction is one of the most dangerous industries in the UK, the HSE is concerned about the safety measures and wants to work to reduce the number of construction-related accidents.
Philip White, the Chief Inspector of Construction at the HSE stated that every year there are a number of accidents and deaths at construction sites which can be avoided if safety procedures are followed. He said that although there have been improvements in certain sectors, some, especially where small projects are concerned, still appear to have a lax attitude. The current initiative will primarily focus on roof top constructions and refurbishments as a vast number of accidents are recorded here. The inspectors will visit these sites without prior intimation to check for proper maintenance of the site and construction related safety concerns.
The HSE believes that a relaxed attitude on health and safety on construction sites is the main factor that puts lives at risk. They have stated that they will take action against offenders and will close down and prosecute those who do not follow the regulations and continue with unsafe practices.
