Optician to Pay £3,696 Fine for Cheating Staff Out of Minimum Wage

An optician who owns two stores in Liverpool was recently penalised by a Manchester court under six charges of breaching the regulations of the National Minimum Wage Act and his failure to pay his staff the legal minimum wage.

Benjamin Gains, 28, who operates under the trade name BG Optical, made annual contracts with his staff according to which their salary was as good as the National Minimum Wage (NMW). They were also to be provided with fully paid meal packages during office hours.

However, in reality the employees were given salaries less than the NMW.

After HM Revenue & Customs (HMRC) received complaints about Gains’ unfair policies they contacted him for an investigation. Now desperate to save himself, Gains asked the staff for their contract papers, made changes and even left out the free-meal provision.

The case went up for hearing at the Manchester magistrates court.

Mike Rainford, defence, said Gains had succumbed to “severe financial pressure” following the bank’s threat that they would cut his loan amount or even completely roll it back.

He also told the court that Gains had just been deducting a trifling amount of money from the salary that his employees were supposed to receive under the NMW.

Gains, however, pleaded guilty to violating the NMW Act and cheating four employees. Consequently the court asked him to pay £3,696 as fines.

Previously, Gains had made an offer to pay back his staff if HMRC dropped the case against him. But now Gains is under legal obligation to pay back his staff within 28 days.
