Tarmac Ltd of Wolverhampton have been penalised for an accident that occurred at their quarry in Bridgend, causing serious injuries to a 15-year-old boy who had entered the premises without permission. HSE has asked quarry owners and constructions sites to ensure that entry to such high-risk areas is effectively barricaded for outsiders. Two other accidents occurred recently, involving injuries sustained by unauthorised entrants to high-risk premises.
Following these incidents, the Health and Safety Executive has appealed to quarry owners to put in place adequate barricades to make sure that outsiders do not gain access to such areas. In this case, the owners of the quarry were charged with violation of Regulation 16 of the Quarries Regulations 1999 and asked to pay about £17,000 in total, including a fine of £10,000 and costs of £6,930.85. Tarmac Ltd pleaded guilty to the charges.
This accident occurred when a 15-year-old boy gained access to Tarmac-owned Cornelly Quarry with his friends. The access to the quarry was usually protected by a thick hedge running along the perimeter, but as plans to expand the site had been finalised, the hedge had been removed. Two earth banks had been constructed in the place of the hedge. However, a delay in the expansion work had resulted in the earth banks being the only barricade for the site.
The teenaged boy had easily crossed the earth banks and entered the quarry site where he sustained a 50 ft fall that left him with a fractured wrist and elbow, in addition to a chipped pelvic bone. After investigations at the accident site, HSE inspectors remarked that the fall could have been fatal considering the height from which the boy fell.
Commenting about the case, Alan Strawbridge, HSE Inspector, said that while it is clear that the boy was at fault for entering a restricted area without permission, the quarry should have taken into consideration the health and safety consequences of such trespass. It should have ensured that only permitted members of the public could enter the risk area with prior authorisation, because the dangers posed in the quarry were sufficiently high.
